My husband and I moved into this house in February 2011. This home is in the neighborhood I grew up in, where my parents still live, and we knew that the house had been empty for at least a couple of years. The owner, my current landlord, had gotten remarried and had not been living in the house for quite some time. She wanted to sell the house but the price was just to high. So, my husband and I agreed to rent the house. We originally signed a year’s lease and we paid an extra deposit because we have a dog in the house. In the two years we have lived there we paid the rent on time every month except for one month when we were out of town and paid it 5 days late. During this time the only repairs that the landlord has had to make was last August when our air conditioner quit working and she paid to put a new one in, which my dad did for her at a much cheaper price than she would have paid elsewhere. She also had to recently pay to have a breaker replaced in the breaker box.
Now jumping forward to today’s problems. When the new AC unit was installed she was told that the duct work under the house really needed to be fixed and new returns ran inside because of the size of the new unit in comparison to the old one. She was also told about some electrical issues under the house with an old furnace and breaker box that is under the house, with wires exposed.
She claims that she can not afford to fix these problems. She told me today that she had breast cancer and had to have a mastectomy therefore right now she couldn’t afford to fix this stuff and she was “focusing on her health”. Now don’t get me wrong, I’m sorry to hear that she has cancer but the fact is I am paying my rent on time every month. Shouldn’t she be able to use that money to pay for repairs? I know that her house payment is significantly lower than what we pay in rent. It just really makes me mad that she will not fix anything when these are the only things we have asked her to fix in the past two years. There have been many other things that needed fixed that we have just taken care of on our own and did not ask her to fix.
We are at the point that we are looking for other housing options. We love this house but I don’t want to continue to make house payments for someone who refuses to fix what needs to be fixed. I know when we tell her we are moving the problem is going to be getting our deposit back. According to Kentucky law, landlords are required to hold a tenant’s deposit in a separate bank account and by law she can not hold us responsible for damages because when we moved in she did not provide us with a list of any damages to the property. When we do leave I will leave the house is spic and span condition and I will shampoo all the carpets before leaving but I just have a feeling she will try to find some reason to withhold our deposit. Thankfully I have researched tenant/landlord laws and I am prepared.
Has anyone else experienced landlord problems? How did you deal with them? I’d welcome any advice!
